About This Project

The purpose of this project is to update the Town of Clarence's zoning and related land use code chapters to create a modern regulatory framework that aligns with the goals and recommendations of current planning documents. This ensures that the needs of current and future residents are met. Throughout this project, the Town, with support from CPL, will conduct a thorough analysis to identify deficiencies and inconsistencies in the current code. We will also look for opportunities to improve the code’s overall format, legibility, and ease of use. Additionally, an implementation strategy will be developed to efficiently use financial and labor resources, determining which updates can be handled internally and which require the assistance of consultants. This holistic approach aims to create a more effective and user-friendly land use code that supports sustainable development and growth in our community.

Why Update the Code?

  • 1. Zoning codes are essential tools for managing changes in the built environment. They set infrastructure standards, guide housing design, and regulate business practices, promoting public safety, health, and community well-being.

  • 2. Zoning code documents must be navigable, comprehensible, and provide a logical, equitable, and consistent framework for reviewing and issuing land development and building permits.

  • 3. Although Clarence's zoning code, last amended in May 2023, has commendable aspects, it needs a comprehensive update to align with Clarence 2030 - The Town's Comprehensive Plan.

How Will the New Code Be Structured?

In order to better align with the community’s vision and modernize the code, this comprehensive update will utilize a type of land-use regulation called a Unified Development Code (UDC). Unified Development Codes streamline and coordinate the development process by removing inconsistencies and outdated policies. They consolidate required permits, processes, and regulations into one place, making it easier for developers, the public, and public entities to understand requirements. UDCs use clear, consistent language, definitions, and include many illustrations and tables in attractive, easy-to-read formats to help stakeholders understand the regulations.
